2. Scope of These Terms

These Terms of Service govern your use of this website and all purchases made through it. By browsing or placing an order, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

3. Products

Noem Brands sells men's clothing and footwear. Product descriptions, images, and sizing information are provided in good faith. Color rendering may vary slightly depending on your device's display settings. If you receive an item that does not match its description, please contact us at info@noembrands.com within 48 hours of receipt.

Noem Brands reserves the right to modify, discontinue, or limit quantities of any product at any time without prior notice.

4. Pricing and Payment

All prices are displayed in US Dollars (USD) and are inclusive of any applicable taxes shown at checkout. Noem Brands reserves the right to correct any pricing errors before fulfilling an order.

Payments are processed securely through Shopify Payments. By submitting your payment information, you represent that you are authorized to use the payment method provided. Noem Brands does not store your full card details — payment data is handled by our payment processor in accordance with PCI-DSS standards.

5. Order Confirmation and Acceptance

After placing your order, you will receive an order confirmation email. This email is an acknowledgement of receipt, not an acceptance of your order. Acceptance occurs when your order is dispatched and a shipping confirmation is sent. Noem Brands reserves the right to cancel any order prior to dispatch — for example, due to stock unavailability or payment issues — and will issue a full refund if this occurs.

6. Shipping

Noem Brands ships exclusively within the United States. Orders are processed within 1 to 2 business days and delivered within an estimated 7 to 16 business days from dispatch. Shipping is free on all orders. Full details are set out in our Shipping Policy.

7. Returns and Refunds

Noem Brands offers a 90-business-day return window from the date you receive your order, subject to the conditions described in our Returns & Refunds Policy. Items must be unworn, unwashed, and in their original condition with all tags attached. Footwear must be returned in its original box with no signs of wear on the soles.

8. Intellectual Property

All content on noembrands.com — including text, images, logos, graphics, and product photography — is the property of Noemi Rodriguez trading as Noem Brands or its licensors. Reproduction, distribution, or commercial use of any content without prior written authorization is prohibited.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Noem Brands' total liability to any customer shall not exceed the total amount paid by that customer for the order giving rise to the claim. Noem Brands shall not be liable for indirect, incidental, or consequential losses. Nothing in these Terms limits any rights you have under mandatory US federal or Illinois state consumer protection law.

10. Consumer Rights — Illinois Residents

These Terms are governed by the laws of the State of Illinois and applicable US federal law, including the Illinois Consumer Fraud and Deceptive Business Practices Act (ICFA), 815 ILCS 505/, and applicable FTC regulations. Illinois residents who believe their consumer rights have been violated may contact the Illinois Attorney General's Office at www.illinoisattorneygeneral.gov.

11. Dispute Resolution

In the event of a dispute, we encourage you to contact us first at info@noembrands.com so we can resolve the matter directly. If a resolution cannot be reached, you may pursue any remedies available to you under applicable Illinois and federal consumer protection law.

12. Modifications

Noem Brands reserves the right to update these Terms of Service at any time. Changes will be published on this page with an updated date. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
